Any review of this book should start off by telling the potential reader what the book is and is not. It is not a book intended to shield assets against the tax authorities or creditors. It is a book intended to assist in the smooth transition of assets from the deceased to his heirs in a cost-effective manner as possible. It is intended to minimize the costs associated with probate (primarily court and administrative costs that can be avoided through the use of a trust as opposed to a will). It should also be stressed that the book is intended for those with a relatively small amount of assets (under about $5.5 mn as of the date the book was written – the estate tax laws passed in December 2017 have now eliminated this ceiling). The book makes the case, very well, as to why for most people trusts are better than wills (and why). This book is a must read for most people trying to answer this question.
This applies to the Kindle edition. It wasn't until I was finished with the book and went back to get my highlights that I realized the system had changed with these "export limits." This publisher allows such a small percentage for a book full of important information. Having all these highlights that are half complete, it's useless to me as a a reference. If had to do it over, I'd buy the cheapest used print version and highlight with a yellow marker. It'd be more complete and easier to refer back into, by going to the relevant chapters. The limits on the highlights will be fine for many books, but for something like this...it's very limiting.
The best "how to" books on revocable trusts that I have found so far, as it gives you "pros and cons" of having a Living Trust, especially if your concern and objective is to avoid costs of probate and manage disposition of your accumulated estate. Well written, easy to read and lays out " what you can do" and "should not do", in developing a Living Trust, as well as procedures for executing the trust when the time comes for execution by the trustee(s). Full of valuable insights on why the Living Trust is a living document, that most any average family or individual should have available to implement a legal/financial structured document throughout their life times. This book enables everyone to have an orderly resolution of accumulated life time assets, leading to final end of life disposition problems, which most families and individuals will eventually encounter. No one takes a u-haul trailer to their cemetery!
I am an estate planning attorney in the Tampa, FL area and discovered this book about one month ago. I have been reading thru it myself, and, not only have I gotten great personal value from this book, but I also intend to give this book to my trust clients after I create their trust. It has an excellent section on "what to do with the trust once its creator (grantor/settlor) passes away." Great product for attorneys, financial advisors, folks looking to create an estate plan, and trustees and/or beneficiaries/family following the death of someone who had a trust in their estate plan.
